I am contacting you to request a meeting.
I have acquired evidence pertaining to the missing child HaLeigh Cummings and crimes that have been committed in Polk County, Minnesota pertaining to that case.
I am the victim of the aforementioned crimes.
As you know, East Grand Forks Police records contain a police report filed on July 26, 2011 by Tina Church. The report states I claimed to have the missing child HaLeigh Cummings in my apartment.
HaLeigh is presently a Missing Person being sought by the FBI.
I have obtained a recorded statement from Tina Church, Specialized Investigative Consultants, Mishawka, Indiana. She states she was impersonated by a woman from Florida named [REDACTED] who along with Levi Page, Dover, Tennessee, made the false police report. She further states she has a recording of the crime being committed.
I possess extensive evidence that shows multiple out-of-state actors conspired with multiple members of law enforcement and government officials to form a plan to secretly violate State and Federal statutes; multiple States: both criminal and civil.
The evidence implicates members of the East Grand Forks Police Department.
Some of the evidence I possess has never been seen or heard by anybody.
I am requesting a meeting with you to turn over the evidence for prosecution.
The average American might wonder how this case would have been handled if the missing child’s name in the false police report would have been “Jacob Wetterling” instead of “HaLeigh Cummings”.

The following story was published by Write Into Action on November 27, 2016.
Tina Church, a private investigator with Specialized Investigative Consultants, told Write Into Action that a police report on file at the police department in East Grand Forks bearing her name and telephone number was not made by her.
Church telephoned Write Into Action today and said the police report was made by a former HLN pundit named Levi Page and a woman from Florida.
“I have a tape that confirms it was not me that made that report against you to the police. It was [REDACTED] acting as me, with Levi Page,” Church said.
The name of the female is being withheld and has been provided to law enforcement.
Write Into Action knows the female referenced and has extensive recorded interviews of the person claiming to know everything that happened to HaLeigh Cummings.
The police report at issue was made in July, 2011 when a caller told Officer Michael Anderson, EGFPD, that Timothy Charles Holmseth, a local journalist, claimed to have the missing child HaLeigh Cummings in his apartment.
Levi Page was investigated by the EGFPD in July, 2015 regarding sexual stories he was fabricating and publishing about the children of Timothy Charles Holmseth, publisher, Write Into Action.

Page, along with a shadowy group that includes Nancy Grace’s reporter Art Harris, have stalked Holmseth since 2009 and used extortion, extreme defamation, false police reports, death threats, and a threat to kidnap Holmseth’s grandchild, in efforts to silence him.
Holmseth possesses evidence that proves Lt. Detective Rodney Hajicek, EGFPD, secretly conspired against Holmseth with others including Harris using private methods of communication including his personal Gmail account.
The secret emails were obtained through a public records request from Polk County Attorney Greg Widseth.
Church said she contacted Write Into Action today because is concerned about several articles that mention her.

Church said her name is “Tina Church” not “Christine Church” and insists she is not the person Wayanne Kruger met and filmed meeting with HaLeigh Cummings’ mother and grandmother in 2009 shortly after the little girl disappeared.
Holmseth has been in contact with both EGF Police Chief Michael Hedlund and Polk County Attorney Greg Widseth regarding this matter.
Hedlund and Hajicek have steadfastly refused to make a referral regarding the kidnapping case to the FBI.
Holmseth says (I say) any outside agency’s investigation is going to lead right back to EGFPD officers and East Grand Forks City Attorney Ronald Galstad.

STATEMENT OF FACTS
PETITIONER believes the facts and circumstances that surround this civil action potentially affect the very safety and well being of the national public and national security.
PETITIONER has been notified by the Grand Forks Police Department that said agency intends to destroy police body-cam and dash-cam public records regarding the pursuit and shooting of David James Elliott (hereby referred to as the Elliott Event) that occurred on February 27-28, 2015 in the State of North Dakota.
PETITIONER seeks for the Federal Court to halt any and all destruction of files pertaining to the Elliott Event.
PETITIONER has standing requests for public records from multiple agencies.
PETITIONER is being improperly denied public records by DEFENDANT CITY OF GRAND FORKS/GRAND FORKS POLICE DEPARTMENT (hereby referred to as GFPD).
PETITIONER is seeking the fulfillment of his Public Records requests from all agencies.

PETITIONER has received police-cam evidence from the GFPD that has clearly been altered using a video editor to prevent PETITIONER, and the public, from knowing the true facts and circumstances surrounding the pursuit and police shooting of David James Elliott.
PETITIONER has published a short video that serves as Prima Facie evidence that criminal alterations of police-cams have occurred. PETITIONER is enclosing a CD with this Petition that features the video showing how the body-cams have been altered.
DEFENDANT GFPD via Police Chief Mark Nelson, set forth a “Special Order” on June 26, 2016 to change the retention dates on police-cam evidence in the GFPD’s custody after PETITIONER discovered cam evidence and had been altered to hide criminal and nefarious acts.
PETITONER asserts the “Special Order” was made in bad faith and was done in the act of a Criminal Conspiracy.
RESPONDENT UNIVERSITY OF NORTH DAKOTA – UNIVERITY OF NORTH DAKOTA POLICE DEPARTMENT (hereby referred to as UNDPD) has provided PETITIONER public records that appear to be altered and/or tampered with.
PETITIONER has been threatened by anonymous persons using voice changing software over the telephone and Web and warned to remove all of his websites or suffer serious consequences. PETITIONER’S children and grandchild have also been threatened.
PETITIONER has obtained evidence that shows RESPONDENT(S) are involved in the commission of state and federal crimes including Conspiracy and Attempted Murder.
RESPONDENT GFPD is planning to destroy evidence for the express purpose that it shows RESPONDENT(s) attempted to murder an unarmed man, David James Elliott; and for the purpose of destroying evidence to avoid prosecution.
PETITIONER argues the following supports an Injunction:
Irreparable Harm: If RESPONDENT destroys the files in question, they will never again be retrievable through RESPONDENT’S Keeper of Records.
Clear Legal Right: PETITIONER has a clear legal right to the files, which are public record.

Legal Challenge: The stated basis for RESPONDENT’S decision to destroy the files is subject to legal challenge.

BOMBSHELL DOCUMENT: Police Chief secretly plots to destroy police shooting video

Grand Forks Police Chief Mark Nelson is the poster child for why people across the United States are beginning to completely hate the police.
An internal GFPD document obtained by Write Into Action shows Nelson diabolically planned to hide the truth behind the police shooting of an unarmed man.
On June 26, 2016, amidst a journalist’s independent investigation into a police shooting, Nelson drafted a “Special Order” to change the retention dates of video evidence so his department could then ‘legally’ purge officer cam video from the system.
On July 11, 2016 GFPD contacted Write Into Action and cited the Special Order as the reason they would be destroying the files.
The abrupt advisement of the file purge came in the wake of an article Write Into Action published regarding the police shooting cases of Philando Castile and Alton Sterling.
Write Into Action revealed to the public that North Dakota Bureau of Criminal Investigation (BCI) files showed that after (former) University of North Dakota police officer, Jerad Braaten, shot David James Elliott, an unarmed man, he threw his body cam under his squad car; his dash cam video completely disappeared.
Nelson is now attempting to cover-up federal crimes.
Timothy Charles Holmseth (Write Into Action) has submitted an Emergency Motion to the United States District Court – District of Minnesota – seeking an Injunction that would forbid the destruction of the evidence.
THE DAVID JAMES ELLIOTT SHOOTING
On February 28, 2015, David James Elliott was shot multiple times in the head by a UND police officer in the Emergency Room parking lot of Altru Hospital in Grand Forks.
Law enforcement refused to talk to the media for almost three days after the shooting, which drew the ire of regional media. The North Dakota Bureau of Criminal Investigation told news reporters the police were not being honest about why they would not talk to the media.
Write Into Action has acquired a plethora of evidence that shows the Elliott shooting was actually a premeditated (attempted) murder; possibly related to a transnational drug trafficking network running drugs through the University of North Dakota and surrounding regions.
The reason police refused to talk to the media may have been a waiting game being played out to see if Elliott would die. However, he survived and the police were eventually forced to talk.
Write Into Action has evidence that (former) UND police officer Jerad Braaten attempted to shoot David Elliott several minutes before the actual shooting; at a different location; but his gun jammed.
According to a person that identified himself as David James Elliott, Braaten tried to shoot Elliott atop the Columbia Road Bridge in Grand Forks where Elliott had his pick-up truck stopped and his arms out the window.
Video of the alleged first shooting attempt may have been captured on video. However, it has been covered up by Nelson and the GFPD by redacting that segment of activity on the bridge.
Braaten allegedly lied to investigators about the first shooting attempt until confronted with a cartridge from his firearm found atop the bridge that had his fingerprints on it.
No video of the actual shooting has ever been released.
In video obtained by Write Into Action, a Grand Forks police officer that appears to have purposely covered his camera with his coat, captures audio of police officers screaming “show me your hands” at Elliott after he has already been shot.
The audio is a disturbing specter that is nothing short of insanity.
Elliott had been shot multiple times in the head and is believed to be completely unconscious. According to a source, Elliott’s bleeding body fell out of his pick-up cab like a “sack of potatoes” where screaming officers repeatedly tazed him as they screamed “show me your hands”.
The instinct of the officers to immediately create the illusion that Elliott posed a threat gives rise to concerns about the actual intent of the continued tazing of the man.
According to a source, two of David Elliott’s fingers were completely blown off as Braaten fired rounds at his head; where Elliott’s hand was holding his cell phone as he was talking to 911. Strangely – Elliott had been on 911 talking to a GFPD officer for 107 minutes. The public has never heard what was said during that strange call by a man that was refusing to stop for police as he tried to reach a hospital emergency room.
Braaten was reprimanded in writing by UND for his misconduct regarding police cams.
And then it becomes off the charts blatant in your face corruption.
After viewing all the evidence and report from the BCI, Grand Forks States Attorney David Jones opined Braaten acted reasonably when he shot Elliott.
Jones’ conclusion is plain and simple – IMPOSSIBLE.
Nelson later hired Braaten to the GFPD – OUTRAGEOUS.

PLAINTIFF’S REQUEST FOR EMERGECNY INJUNCTION
This request for emergency federal relief is brought by Plaintiff/Petitioner TIMTOHY CHARLES HOLMSETH, a resident of East Grand Forks, Minnesota, against Defendants CITY OF GRAND FORKS, COUNTY OF GRAND FORKS, UNIVERSITY OF NORTH DAKOTA, STATE OF NORTH DAKOTA/HIGHWAY PATROL, and ALTRU HEALTH SYSTEMS.

RESPONDENT notified PETITIONER of their plans to destroy the evidence on July 11, 2016, after PETITIONER, on July 9, 2016, published information relating to the national profile shooting of Philando Castile, who was recently shot by a police officer in Falcon Heights, Minnesota.
RESPONDENT notified PETITIONER of plans to destroy the files immediately after PETITIONER made contact with KARE 11, Star-Tribune, KSTP, National Public Radio, and other media outlets.
PETITIONER argues the following supports an Injunction:
- Irreparable Harm: If RESPONDENT destroys the files in question, they will never again be retrievable through RESPONDENT’S keeper of records.

PUBLIC SAFTEY and PUBLIC INTEREST
The abrupt destruction of the files by RESPONDENT is not necessary and does not need to be done for any important reason that would better any existing situation. To the contrary, maintaining the integrity of the files serves the greater good and public interest.
The destruction of the files could potentially serve to fan the flames presently raging across the United States in regards to distrust of the police and future investigations of controversial police shootings.
The destruction of the files could create fodder for violent radical group’s to generate further suspicion and hatred of the police in the wake of recent police shootings, and contribute to the already dangerous level of civil unrest in the United States.
The recent shooting/ambush murder of five police officers at the Dallas Police Department speaks to the colossal public safety issue and potential ramifications of such an irresponsible action by RESPONDENT. Such file destruction could generate a similar incident and turn into a national crisis if the files regarding a suspiciouspolice shooting are suddenly, inexplicably, and cynically destroyed.
The destruction of the files also creates a unique public safety issue pertaining to the residents and citizens of Grand Forks, North Dakota, as well as the entire State of North Dakota and neighboring Minnesota.
PERSONAL SAFETY of PETITIONER
PETITIONER is receiving telephone calls from unidentified persons using voice changing software demanding PETITIONER remove all his publications from the Web.
PETITIONER’S children are also being threatened.
PETITIONER has been taunted in writing and told that the local police are never going to help PETITIONER.
PETITIONER has reported the threats to the police in Grand Forks, North Dakota and East Grand Forks, Minnesota. Law enforcement takes no meaningful action.
PETITIONER believes PETITIONER’S constitutional rights are being violated.
REQUEST FOR INJUNCTIVE RELIEF
PETTIONER is requesting EMERGENCY Temporary Injunctive Relief against RESPONDENT.
PETITIONER is a news reporter, journalist, author, and publisher with an existing media relationship with RESPONDENT regarding the acquisition of public records.
PETTIONER has worked as a news reporter for newspapers of public record in Minnesota and North Dakota, and was recognized with first place awards from the North Dakota Newspaper Association.
PETITIONER is producing a documentary that will include information about the Wal-Mart shooting in Grand Forks, North Dakota by a black man who was stationed at the United States Air Force Base in Grand Forks.
PETITIONER has an existing media relationship with RESPONDENT regarding public records requests relating specifically to the police pursuit and officer involved shooting of David James Elliott, which occurred on February 27-28, 2015.
PETTIONER also has an existing media relationship with RESPONDENT regarding public records pertaining to the un-attended death of Caitlin Jenna Erickson, which occurred on February 27, 2015.
PETTIONER also has an existing media relationship with RESPONDENT regarding public records pertaining to the case of State of North Dakota v. Mohammed Aweis Mohammed that resulted in ‘attempted murder’ charges against the Somali immigrant.
PETITIONER has requested, paid for, and received multiple documents and records including 911 transcripts, police reports, officer body cam, and/or officer dash-cam video, regarding the aforementioned highlighted cases.
PETITIONER also obtained investigative files from the North Dakota Attorney General/North Dakota Bureau of Criminal Investigation regarding the police shooting of David James Elliott.
PETITIONER has regularly published comprehensive articles and stories featuring the aforementioned public records at PETITIONERS websites, including:
PETITIONER is providing a valuable service to the public.
At no time has RESPONDENT notified or advised PETITIONER of any time restraints and/or deadlines regarding records pertaining to the officer involved shooting of David James Elliott; death of Caitlin Jenna Erickson; or attempted murder charges against Mohammed Aweis Mohammed.
To the contrary, RESPONDENT has essentially misled PETITIONER during e-mail communications to believe the files would remain accessible and available.
RESPONDENT has improperly stalled PETITIONER’S information discovery through various stalling tactics by multiple Keeper’s of Record.
On July 11, 2016, RESPONDENT abruptly advised PETITIONER that RESPONDENT would be destroying files pertaining to GFPD IR#201501332 and the files would not be available after Monday, July 18, 2016 (the file pertaining to the police shooting of David James Elliott).
As previously stated, PETITIONER believes this is a premeditated plan to destroy evidence of a crime and/or multiple crimes, and to prevent the American public from viewing the files.
RESPONDENT HAS ALREADY (PREVIOUSLY) ALTERED AND TAMPERED WITH EVIDENCE AND PUBLIC RECORDS
PETITIONER has discovered RESPONDENT has altered public records and tampered with evidence.
RESPONDENT altered officer cam video regarding the police shooting of an unarmed man (David James Elliott) before providing the video to PETITIONER.
RESPONDENT changed existing properties of video files. For example, one instance of evidence-tampering is a dash cam video from the squad car of GFPD officer Dan Harvala that captured the police shooting of David James Elliott. While most video from the dash-cam of Harvala’s car is in color; one portion of the video was altered/changed to appear in black and white. The portion that was altered captured the shooting of David James Elliott. The black and white quality restricts the viewer from seeing the details of the shooting scene due to glare and shadows. All other cam evidence obtained thus far was in color.
PRIMA FACIE EVIDENCE OF UNJUSTIFIED POLICE SHOOTING
PETITIONER obtained BCI files that show UNDPD officer Jerad Braaten’s officer body-cam was found by the BCI investigators underneath Jerad Braaten’s squad car (where he attempted to hide it after he shot David James Elliott).
PETITIONER obtained files that show UNDPD officer Jerad Braaten’s dash-cam video was not available whatsoever to police in any fashion for investigation (because he got rid of it).
PETITIONER obtained files that show UNDPD officer Jerad Braaten was reprimanded in writing by UNDPD chief Eric Plummer for actions involving his officer cameras (see attachment).
PETITIONER obtained the aforementioned evidence and alerted the public that despite the evidence, Grand Forks States Attorney David Jones determined the shooting was justified, and the Grand Forks Police Department went on to hire the shooter, Jerad Braaten, despite all the aforementioned evidence.
On several dates, PETITIONER was contacted by a person identifying himself as David James Elliott.
The person made a plethora of statements, including:
- UNDPD officer Jerad Braaten attempted to shoot him (David Elliott) several minutes before the actual shooting, while atop the Columbia Road Bridge in Grand Forks, but Braaten’s gun jammed.
- UNDPD officer Jerad Braaten lied to investigators about the incident atop the bridge until investigators found his “finger prints” on an un-fired cartridge atop the bridge (the assertion of an attempted shooting atop the bridge appears to be verified by BCI investigators who noted a cartridge from Braaten’s firearm was found on the bridge.)
- Unseen/unpublished/un-released video exists to show police officers repeatedly tazing David James Elliott after he has been rendered unconscious by multiple gunshots to the head.
- Unseen/unpublished/un-released video shows David Elliott’s body fall out of his pick-up like a “sack of potatoes” as police officers continuously yell “stop resisting” at his unconscious body and continuously taze him.
- Unseen/unpublished/un-released video shows “excessive force”.
- Video and evidence was withheld from David James Elliott and his attorney, Darla Schuman, by prosecutors.
- Video was turned over very slowly (suspiciously slow) by prosecutors.
- David James Elliott is receiving death threats.
- The media is not reporting the whole relevant truth to the public.
PETITIONER respectfully requests the United States District Court issue an Injunction forbidding the destruction of GFPD IR#201501332 until further Order of the Court.
The Order further forbids the destruction of any related files held by the University of North Dakota Police Department, Grand Forks County Sheriff’s Office, Grand Forks County States Attorney’s office, North Dakota Highway Patrol, and Altru Health Systems.

Philando Castile shooting protesters justified in doubting investigation

The United States Department of Justice needs to investigate a police shooting in North Dakota.
The body-cam worn by UND police officer Jerad Braaten, who shot David James Elliott, an unarmed man, in a Grand Forks, North Dakota hospital parking lot, was found by investigators underneath the officer’s squad car.
The astonishing revelation comes as protests across the nation are turning deadly due to public trust issues regarding official investigations, and in the wake of the fatal police shooting of Philando Castile, which occurred in neighboring Minnesota.
The U.S. DOJ announced it will monitor the Minnesota BCA investigation of the Castile shooting. Notably, the Minneapolis FBI has territorial jurisdiction for North Dakota.
The revelation regarding the officers attempt to hide his body camera supports the cries of protesters across the nation that are demanding justice, in what appears to be a national ‘Pattern and Practice’ of clearing police officers that are committing murders.
The staggering fact that the UND police officer’s body-cam was found under his car is revealed in a line item of an investigative inventory sheet by the North Dakota Bureau of Criminal Investigation (BCI) obtained by Write Into Action.
Write Into Action has been conducting an in-depth journalistic investigation into the police shooting.
Special Agent Michael Ness recorded in the Inventory Sheet “UNDPD body cam” was found “under UNDPD squad car”.
THE COVER-UP IS WORSE THAN THE CRIME
Write Into Action has uncovered insurmountable evidence that shows an elaborate multi-agency and Institutional cover-up of the police shooting of David James Elliott is underway.
Evidence shows the truth about the shooting is factually known to UND, Altru Health System, ND BCI, and other law enforcement agencies involved.
Evidence strongly suggests the shooting was an attempted murder being carried out in the form of a ‘hit’ – possibly related to drug trafficking in North Dakota and Minnesota.
Grand Forks States Attorney David Jones found Officer Braaten acted within the law when he shot David Elliott.
However, the facts of the case that have come during Write Into Action’s investigation show there is no possible way an honest, law-abiding, reasonable person could have reached that conclusion.
Write Into Action’s investigation has discovered that every single police video obtained thus far appears to be tampered with; contains changed properties; and/or was otherwise altered/manipulated in various ways.
No video released thus far shows the actual shooting.
However, the dash-cam of a GFPD police officer’s squad car that captured the shooting in the distance was inexplicably altered. The color video was changed so it would only appear in black and white. The black and white creates shadows and glare that obfuscates the details in the video. All other video; including video from the same officers car; was in color.
Write Into Action has submitted a public records request to UNDPD for the body-cam of Braaten; the video still has not been delivered.
Write Into Action has obtained evidence that Braaten actually attempted to shoot Elliott a few minutes prior to the actual shooting, while Elliott’s vehicle was stopped atop the Columbia Road bridge in Grand Forks with his arms out the window, surrendering. The first attempt failed because Braaten’s gun jammed.
Braaten allegedly lied to investigators about a cartridge located atop the bridge, and only admitted he had performed an action with his gun on the bridge, after his fingerprints were found on the cartridge.
Write Into Action exclusively obtained and published UNDPD records show Braaten was disciplined for actions he took regarding his police cameras.
Braaten was later hired by the Grand Forks Police Department.
David Elliott’s lawyer on the case, Darla Schuman, has not responded to requests for comment.

“Dear Mr. Wellstone: I was a police officer…”

Minnesota Governor Mark Dayton posed a rhetorical question upon learning of the police shooting death of Philando Castile on Wednesday.
“Would this have happened if those passengers, the driver and the passengers, were white?”

Congressional records obtained by Write Into Action reveal Gov. Dayton has simply posed the wrong question.
The real question is…
Would this have happened if the U.S. DOJ and FBI had properly acted upon a referral from former Minnesota Senator Paul Wellstone regarding a Minnesota police officer that came forward about abuse and mysterious deaths in the State?
The proper question may sit within the four cryptic words continuously repeated by presidential candidate Donald Trump regarding the truth behind our government and it’s bizarre spiral into insanity. .

The document dump obtained by Write Into Action is disturbing beyond measure and supports Trump’s cynical code-speak.
Essentially – the FBI and U.S. Attorney General’s office appear to have deliberately run out the clock to avoid acting on information received from a 15 year veteran of a police force in Minnesota, which exposed horrific prisoner abuse and may have prevented a graveyard’s worth of mysterious deaths.
The 15 year career of former East Grand Forks Police officer and investigator Gary Deitz ended in termination after he broke ‘The Blue Code’.
The evidence obtained by Deitz was so powerful he actually captured a fellow police officer, Rodney Hajicek, on tape, stating he planned to lie to investigators about an investigation of the Department. Hajicek went onto to become the ranking police officer at the EGFPD; where he remains to this day.
Serious questions are now being raised as to how many congressional complaints and legitimate referrals from police officers and patriotic whistleblowers have been swept under the rug in Minnesota.
As state and federal law enforcement across the nation now brace for what could be a firestorm of violence following the fatal police shooting of Castile; the truth is the American public may only be watching tragic theater.
Sen. Wellstone’s files reveal Minnesota authorities, as well as the DOJ, FBI, and Special Litigations Section in Washington D.C., have long possessed very specific and actionable evidence of police abuse and widespread public corruption in Minnesota at the ‘pattern and practice’ level.
In 1997 Wellstone contacted the Justice Department and requested an inquiry regarding the information provided by Deitz.
Deitz’s initial correspondence with Sen. Wellstone rings sadly tragic today.
Dear Mr. Wellstone:
I was a police officer with the City of East Grand Forks for 15 years. In October 1991, I went to the FBI with many concerns about the city of East Grand Forks, city officials, and most important the abuse of prisoners by police officers. I have developed a heart condition, depression, and Post Traumatic Stress. The Post Traumatic Stress was due to the beating of Jon Osowski and the fact that they covered the incident and did nothing about it. Yet, the beatings continue. The Grand Forks office of the FBI is allegedly looking into the abuse of Dean Bass (dislocated arm while in custody in December 1995) and Neil DesJarlais (three broken ribs while in custody in April 1996) both of them were in custody of the East Grand Forks police department and both are American Indian males.
Subsequent communications between Sen. Wellstone, the Justice Department, and the FBI show Deitz turned over troves of actionable information regarding prisoner abuse and mysterious deaths after eye-witnessing a man beaten to within an inch of his life in the EGF police station.
